B2B WEEE obligations

Under SI 340/2005 Waste Management (Waste Electrical and Electronic Equipment [WEEE]) Regulations, which came into force on August 13th 2005, a producer is required to finance the collection, treatment, recovery or recycling of WEEE that the purchase replaces, on a one-for-one, like-for-like basis.

Under the WEEE Management Regulations, the producer is also required to make arrangements for the financing of the eventual collection, treatment, recovery or recycling of any new electrical and electronic equipment sold after August 2005.

In a B2B environment, producers are entitled to pass the responsibility for the final disposal to the purchaser, as long as this is part of the contract of sale

Companies disposing of equipment purchased before August 2005 and not being replaced, are responsible for the correct disposal of WEEE, in accordance with the provisions of the Irish WEEE Regulations 2005
